The formal divorce process has three steps.
1. Issuing the Divorce Proceedings
One of the parties has to issue divorce proceedings based on fault. The grounds for divorce are as follows:
- Unreasonable behaviour
- Two years separation
- Five years separation
These are needed to prove to the court that this is the reason you want your marriage to end. After this you will have to serve divorce papers to your former partner.

2. Apply for a ‘Decree Nisi’
Once the courts have received the document and both you and your spouse have both told the court that they agree, you can apply for a Decree Nisi. This means you will receive a document that says the court sees no reason you can’t get a divorce.
3. Get a ‘Decree Absolute’
Finally, six weeks after successfully applying for a Decree Nisi, you can apply for a Decree Absolute. This document is the document that legally ends your marriage or civil partnership.
