Wills and Probate Fees

Person  responsible for your work

Pamela Murphy is a STEP Qualified  Solicitor specialising in Private Client Law.  She has dealt with simple and complex estates and administration of trusts.

Costs

Her hourly charging rate is £210 plus VAT and charges for estates are based on one of three ways:-

  • A time only basis
  • A mixture of time and value element.   The value element being based on 1% of real property (any property or land you may own) and ½% of the remainder (any bank or building society accounts and investments).
  • 2% of the whole estate.

Charges on the whole will not normally exceed  2% of the value of the estate and will be dependent on the number of hours spent on a matter and the complexity of the assets.  An estimate will be given to you at the beginning of the matter and updated if necessary every six months.

Work Carried out

The work will include obtaining details of the deceased’s assets and liabilities and preparation of a Schedule of those Assets and Liabilities.  Preparation of the paperwork to lead to a Grant of Probate, including the preparation of HM Revenue and Customs Account (Form IHT400) and supplemental sheets/Return of Estate Information Form (Form IHT205) together with an Oath.  Attending you to sign the paperwork and arranging for you to be sworn to the Oath. The IHT400 and supplemental sheets will be forwarded to HM Revenue and Customs and when the receipted Probate Summary (Form IHT421) is received the application for the Grant will be submitted to the Probate Registry.  

On receipt of the Grant all forms necessary to collect in all the assets will be prepared.  When funds are received payment of the liabilities and any legacies due will be arranged. On completion of all works a full Estate Account will be prepared  for you and forwarded to you for approval. The estate will then be distributed in accordance with the terms of the Will/rules of intestacy.

All HM Revenue and Customs Accounts and Tax Returns will be dealt with during the administration.

Fixed Fee Service

This service is available for obtaining a Simple Grant of Probate the cost of which is £500 + VAT

Work Carried out

I will proceed to obtain details of the deceased’s assets and liabilities and will prepare the paperwork to lead to a Grant of Probate, including the preparation of HM Revenue and Customs Return of Estate Information form (IHT205) and drafting Oath for Executors/ Administrators.  We will then attend to you to sign the documentation and be sworn to the Oath. Once this has been completed we will send all documentation to the Probate Registry and when the Grant is issued, report accordingly.

Additional Costs- Disbursements in addition to the above fees;

  • Probate Application Fee- £155
  • Swearing of the Oath (per Executor)- £7
  • Land registry documents (per property)- £2
  • Bankruptcy only Land Charges Department Search (per beneficiary)- £2
  • Statutory Notices (post in London Gazette/ Local Paper)- Approx. £180 plus VAT  – protects against unexpected claims from unknown creditors

Timescale

A timescale for an estate is again dependent on the complexity of the estate and can range from anything from 6 months to 2 to 3 years.
